These Terms of Use ("Terms") are a binding agreement between you and Attuno ("Attuno", the "app", "we", "us", "our"), operated by its developer Antons Aleksandrovs (sole proprietor), Kupricu iela 1B-43, LV-1021, Riga, Latvia. They govern your use of the Attuno iPhone app and related services. Please also read our Privacy Policy, which is incorporated into these Terms by reference. If you are a consumer, nothing in these Terms removes or limits rights you have under the mandatory laws of your country (including EU/UK consumer-protection law) that cannot be waived by agreement.
By downloading, accessing, or using Attuno you agree to these Terms. If you do not agree, do not use the app. You must be at least 16 years old (or the minimum age of digital consent in your country, and at least 13 in the United States) to use Attuno. If you use the app on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
Attuno is a wellness app that reads data from Apple Health (with your permission) and turns it into calm, plain-language recovery, readiness, sleep, stress, and activity insight. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Attuno for your own personal, non-commercial use on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or create derivative works from the app except where such restriction is prohibited by law.
Most of Attuno works without an account. To use the optional AI tier you sign in with Sign in with Apple, Google, or email/password. You are responsible for keeping your sign-in credentials secure and for activity under your account. Tell us promptly at aleksandrovs.antons@gmail.com if you suspect unauthorised use.
Premium features (including AI insights) are offered as an auto-renewing subscription purchased through the Apple App Store and managed via RevenueCat. The price, billing period (e.g. monthly, six-monthly, or yearly), and any free-trial terms are shown to you in the app at the point of purchase before you confirm.
Apple processes all payments and refunds. We do not receive your payment-card details. Refund requests are handled by Apple under the App Store Terms, and by your statutory rights where they apply.
If you are a consumer in the EEA or UK, you normally have a 14-day right to withdraw from a purchase of digital content. By starting to use a paid digital feature immediately, you ask us to begin performance during that period and acknowledge that, once fully performed, you may lose the right of withdrawal as allowed by law. This does not affect your separate statutory rights if the service is faulty or not as described. Because purchases are made through Apple, withdrawal and refund requests are actioned through Apple; contact us and we will help where we can.
The AI tier generates written wellness insight from an aggregated daily summary of your data (see the Privacy Policy). Insights are informational only, generated by a third-party AI model, may be inaccurate or incomplete, and are not medical advice, diagnosis, or treatment. We may set fair-use limits (such as a daily cap) and may change, suspend, or withdraw AI features.
You agree not to misuse Attuno, including by attempting to disrupt or gain unauthorised access to the app or its backend, probing or bypassing security or App Check, scraping, or using the app for any unlawful purpose or in breach of Apple's or Google's terms.
Attuno, its name, logo, design, and software are owned by us or our licensors and are protected by intellectual-property laws. These Terms grant you no rights in our trademarks or content except the limited licence to use the app. Your health data and content remain yours.
Attuno is a wellness app, not a medical device. Scores, charts, and insights are for general informational purposes only and are not medical advice, diagnosis, or treatment. Always consult a qualified health provider with questions about a medical condition, and never disregard professional medical advice because of something you read in this app. If you think you may have a medical emergency, call your local emergency number.
Metrics come from your Apple Watch and iPhone sensors via Apple Health and can be incomplete or imprecise. Treat trends as guidance, not ground truth.
To the maximum extent permitted by law, Attuno is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or available at all times. If you are a consumer, this section applies only to the extent permitted by your local law, and your statutory guarantees are unaffected.
To the maximum extent permitted by law, we (and our developer, suppliers, and licensors) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or relating to your use of, or inability to use, Attuno. Our total aggregate liability for direct damages is limited to the greater of the amount you paid us for the app in the 12 months before the claim, or USD 50.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under applicable law. Consumers retain all mandatory statutory rights.
To the extent permitted by law, and except where you are a consumer using the app for personal purposes, you agree to indemnify us against claims arising from your unlawful use of the app or your breach of these Terms.
We may update, change, or discontinue features of the app. We may also update these Terms; the "Last updated" date above will change and, where the changes are material, we will give reasonable notice (for example, in the app). Continued use after changes take effect means you accept the updated Terms. If you do not agree, stop using the app and, if you wish, cancel any subscription.
You may stop using Attuno at any time and delete the app. We may suspend or end your access if you materially breach these Terms or use the app unlawfully. Sections that by their nature should survive (such as disclaimers, limitation of liability, and governing law) survive termination.
These Terms are governed by the laws of the Republic of Latvia, without regard to conflict-of-laws rules. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We would always prefer to resolve issues directly — please contact us first.
These Terms are between you and us, not Apple, and Apple is not responsible for the app or its content. The licence in Section 2 is limited to use on Apple-branded devices, as required by the App Store Terms. You acknowledge that:
